SUPPLY TERMS AND CONDITIONS
General terms and conditions of sale
This section contains the general terms and conditions of sale applied to sales carried out via the online Tony Arbolino Shop, Via Saronnino 86, 21040 Origgio (VA), Italy.
Relationships between the parties are regulated exclusively by these terms and conditions. The Client is obliged to read the entire document before proceeding with purchases. The terms and conditions contained within are considered to be unconditionally accepted at the moment in which the Client completes an order on the website as described below.
Purchase procedure
The Client can view the products in the catalogue online, with descriptions in the individual information sheets. In order to proceed with the purchase, the Client must first register on the Tony Arbolino Shop website and make an order, following the instructions for payment. On confirmation of the order, the Client also undertakes to provide a functioning email address and a mobile telephone number in the event that contact is necessary.
The correct receipt of the order and the payment made by the Client is confirmed by Tony Arbolino Shop via a response, referred to as “Order confirmation”, sent to the email address provided by the Client. The aforementioned email also indicates the “Client Order Number”, which is essential for any communication between the parties, as well as a summary of the order. The Client undertakes to verify that the data contained in the message are correct, and to communicate any inaccuracies within 3 days of receipt of Confirmation.
Tony Arbolino Shop undertakes to inform the Client of the unavailability of any of the requested merchandise within 15 days of the date of order, of any delays in consignment of the merchandise and of the relative right to cancel the order.
In the event that the unavailability of a product is due to the definitive termination of production of the same, Tony Arbolino Shop undertakes to offer the Client the supply of an item of equal quality and price as that originally ordered; in the event that the Client refuses the substitution, Tony Arbolino Shop will undertake to refund the price paid for the unavailable product.
Prices
The prices shown on the website are inclusive of VAT and DO NOT include shipping costs, which are payable by the Client, according to the following rate: • Shipping via the courier GLS: € 6.90 VAT included.
Shipping costs are added at the end of the order process as a supplementary fee to the products purchased. Tony Arbolino Shop reserves the right to modify sales prices and shipping costs at any time, but guarantees to charge the Client with the prices actually shown on the website at the moment of ordering.
Method of payment
The Client may pay the order by:
Advance bank transfer: the items ordered by the Client are set aside until the receipt by Tony Arbolino Shop of proof that the bank transfer has been made, to be sent by the Client to the address and in accordance with the methods communicated in the Order confirmation, via fax or email within and no later than 3 (three) working days from receipt of the same;
Credit Card: payment is accepted via all major credit cards, including pre-paid or rechargeable cards, that have been issued exclusively in Italy and belong to the CartaSi, Visa, Visa Electron, Mastercard or Maestro circuits.
No additional commission will be charged to the Client in the event of payment via credit card.
Tony Arbolino Shop reserves the right to ask the Client for additional information such as telephone number, tax code or a copy of an identity document as proof of ownership of the credit card used; in the event that the requested data are not provided by the Client, Tony Arbolino Shop reserves the right to not accept the order.
Method of delivery
Tony Arbolino Shop uses the Courier GLS for delivery in Italy.
Delivery times can vary from 2 to 5 working days from the date of payment or from the moment in which Tony Arbolino Shop informs the Client of the availability of the merchandise. In the case of purchase of goods to order (not available in the warehouse), delivery times can range from 30 to 40 working days. In this case, Tony Arbolino Shop undertakes to provide more precise details in accordance with the characteristics of the individual product via direct mail or telephone contact with the Client.
Once the goods have been received:
• The Client must check the integrity of the package;
• In the event of material external damage to the package or packaging due to transportation:
the Client must write on the delivery note “Accepted subject to verification” together with the detailed indication of the visible damage to the package (e.g. package wet, package open, etc.); within 48 hours of receipt of the package, send an email to Tony Arbolino Shop indicating the information regarding the delivery and the relative problems. Late or incomplete requests for refunds WILL NOT be accepted;
• If the package is undamaged, the Client must accept the delivery.
Any damage to the product must be reported to Tony Arbolino Shop within 48 hours from delivery via email or telephone together with the sending of the faulty goods directly to Tony Arbolino Shop.
Right to withdraw
The Client has the right to withdraw from the order in the event of delays in the delivery of the goods.
Substitution of faulty goods
Goods delivered and considered to be faulty at the moment of delivery - and considered so by Tony Arbolino Shop - will be substituted free of charge; no other additional compensation will be recognised beyond the substitution of the goods considered to be faulty. All the products are sold under the condition that the Client autonomously assesses the suitability of the items purchased for their intended use, with the Client assuming in this case all risks and responsibility resulting from said use. Any disputes arising from the interpretation or the execution of contracts governed by these Terms and Conditions of Sale will be the exclusive jurisdiction of the Varese Law Court.
Privacy
The information requested by Tony Arbolino Shop from the Client is essential for the fulfilment of the contractual obligations held in their regard, the confirmation of orders and the invoicing of the same. The lack of said information or the refusal to provide the same will result in the cancellation of the order by Tony Arbolino Shop.
On registering with the website, the Client is required to provide personal information that is truthful and sincere; the violation of said obligation will result in the cancellation of the orders made, without prejudice to the right of Tony Arbolino Shop to claim for any damages and to inform the relative Authorities of any abuse or violation committed.
Tony Arbolino Shop is authorised to collect, process and use the personal data communicated by the Client, which are subject to computerised processing and storage compliant with current regulations regarding privacy. The Client has the permanent right to access and modify their own personal data in compliance with relative regulations. The Client is aware of the right of Tony Arbolino Shop to send promotional emails containing offers, news or exclusive items; the Client has, in any case, the right to request the termination of the sending of said communications.
